1. Acceptance of Terms
By accessing or using Zenith Code Inc. ("Zenith Code") websites, mobile applications, games, products, and services (collectively, the "Services"), you ("User" or "You") agree to be bound by these Terms of Service ("Agreement"), our Privacy Policy, and any applicable additional terms referenced herein. If you do not agree to all terms of this Agreement, you may not access or use the Services.
This Agreement constitutes a legally binding contract between you and Zenith Code Inc., a company registered in Reno, Nevada, USA, with registered address at 1695 Meadow Wood Lane, Suite 303, Reno, NV 89502, USA.
2. Eligibility
2.1 Age Requirements
•You must be at least 13 years of age to use the Services. If you are between 13 and 18 years old (or the legal age of majority in your jurisdiction), your parent or legal guardian must review and agree to this Agreement on your behalf.
•Parents and guardians are fully responsible for all actions of minors using the Services, including any purchases made through the Services.
2.2 Account Registration
•Certain Services may require you to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
•You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account. You agree to notify Zenith Code immediately of any unauthorized access to or use of your account.
3. License Grant
Zenith Code grants you a personal, non-exclusive, non-transferable, revocable license to access and use the Services for non-commercial purposes, subject to compliance with this Agreement. This license does not include:
•Any resale or commercial use of the Services or any content therein
•Modification, adaptation, reverse engineering, decompilation, or disassembly of any part of the Services
•Distribution, rental, leasing, or sublicense of the Services to any third party
•Use of any automated software, bots, or scripts to access or interact with the Services
•Removal or modification of any proprietary notices, trademarks, or copyright material
4. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
•Violating any applicable laws, regulations, or third-party rights
•Using cheats, hacks, mods, or other unauthorized software to gain an unfair advantage in games
•Harassing, bullying, threatening, or defaming other users
•Infringing upon Zenith Code's intellectual property rights or the intellectual property rights of others
•Disclosing personal information of other users without their consent
•Engaging in fraudulent or deceptive practices, including but not limited to unauthorized purchases or account sharing
•Interfering with or disrupting the Services, including servers and networks connected to the Services
•Attempting to gain unauthorized access to the Services or user accounts
5. Intellectual Property
All content and materials available through the Services, including but not limited to games, software, graphics, text, images, and trademarks, are the property of Zenith Code or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You acknowledge that you do not acquire any ownership rights by using the Services. All rights not expressly granted herein are reserved by Zenith Code.
6. In-App Purchases
•Certain Services may offer in-app purchases of virtual items or currency. All purchases are final and non-refundable, except as required by applicable law.
•You agree to pay all fees associated with in-app purchases at the time of purchase. Zenith Code reserves the right to change pricing for virtual items or currency at any time.
•Virtual items and currency have no monetary value and cannot be redeemed for real money, goods, or services.
7. Termination
Zenith Code may terminate or suspend your access to the Services at any time, with or without notice, if you violate this Agreement or for any other reason in our sole discretion.
Upon termination:
•Your license to use the Services will immediately cease
•You must cease all use of the Services
•You will forfeit any virtual items or currency associated with your account
8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Zenith Code does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. You acknowledge that your use of the Services is at your own risk.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ZENITH CODE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
ZENITH CODE'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID TO ZENITH CODE FOR THE SERVICES IN THE PAST TWELVE (12) MONTHS, OR $100 IF YOU HAVE NOT MADE ANY PAYMENTS.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada, USA, without regard to its conflict of law principles.
11. Changes to Terms
Zenith Code reserves the right to modify this Agreement at any time. We will notify you of any material changes by posting the updated Agreement on our website with a new "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the modified Agreement.
